Terms of Use

1. What Curalia is
Curalia is operated by Tigris Guardians Inc. (“Curalia”, “we”, “us”). Curalia is a technology platform that lets you find partner pharmacies and book virtual (video or voice) minor-ailment consultations with licensed pharmacists in Ontario. By creating an account or using the apps or website, you agree to these Terms of Use and to our Privacy Policy.
2. Curalia does not provide medical care
The pharmacy you book with — not Curalia — provides your clinical care. Assessments, advice, and prescribing decisions are made by the pharmacy’s licensed pharmacists within their provincial scope of practice, and the pharmacy is the health information custodian of your clinical records. Curalia supplies the technology only and does not supervise, direct, or control any pharmacist’s professional judgment.
3. Not for emergencies
Do not use Curalia for medical emergencies. If your symptoms are severe or life-threatening, call 911 or go to the nearest emergency department. Virtual minor-ailment care is not a substitute for emergency or urgent in-person care.
4. Eligibility
- You must be physically located in Ontario at the time of your consultation, and you attest to this before each visit.
- Minor-ailment consultations are free with a valid Ontario health card. The pharmacist verifies your physical health card with you on the call.
- You must be at least 16 years of age to hold your own account. Younger patients may use the service only through a parent or legal guardian, who must be present for the consultation. [TODO: confirm age threshold with legal counsel.]
- The pharmacist decides whether a virtual visit is clinically appropriate and may refer you to in-person care instead.
5. Your account and acceptable use
- Provide accurate information about yourself, and keep your account credentials to yourself. You are responsible for activity on your account.
- Use the service only for yourself or for someone you are legally authorized to act for.
- Do not misrepresent your identity, location, or health-card status.
- Do not record consultations. Curalia does not record calls, and you agree not to record them either without everyone’s consent and as permitted by law.
- Do not abuse, harass, or threaten pharmacy staff; do not attempt to obtain medications through deception.
- Do not probe, disrupt, reverse-engineer, or interfere with the platform or its security, or access data that is not yours.
6. Consultation terms
Before each consultation you will be asked to accept our Virtual-Care Consultation Terms, which explain what a virtual consult is and is not, how verification works, and your choices about sharing information.
7. Suspension and termination
You may close your account at any time from within the app (see the Privacy Policy for what happens to your data). We may suspend or terminate your account if you breach these terms, misuse the service, or where required for safety, security, or legal reasons. Where reasonable, we will tell you why.
8. Availability and changes
We aim to keep the service available but do not guarantee uninterrupted operation. We may change, suspend, or discontinue features. If a consultation is interrupted by a technical failure, contact the pharmacy or rebook — do not delay seeking care you need.
9. Limitation of liability
To the maximum extent permitted by law: Curalia provides the platform “as is”; Curalia is not liable for the clinical acts or omissions of any pharmacy or pharmacist, who are independent of Curalia; and Curalia’s total liability to you for claims arising out of the platform is limited to [TODO: liability cap — to be set by legal counsel]. Nothing in these terms excludes liability that cannot be excluded under applicable law, including under Ontario consumer-protection legislation.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes are subject to the courts of Ontario. [TODO: confirm venue/dispute-resolution approach with legal counsel.]
11. Changes to these terms
If we make material changes, we will post the updated terms here, update the effective date, and where appropriate notify you in the app. Continued use after changes take effect means you accept them.
